ایون فیلڈ ریفرنس مریم نواز اور کیپٹن صفدر کی بریت

 

سپریم کورٹ اسلام آباد نے سابق وزیر اعظم محمد نواز شریف کی بیٹی اور مسلم لیگ (ن) کی نائب صدر مریم نواز اور ان کے خاوند کیپٹن (ر) محمد صفدر کو احتساب عدالت کی جانب سے دی گئی سزائیں کالعدم قرار دے دی گئیں اور دونوں کو بری کر دیا اس عدالتی فیصلے کے ساتھ ہی مریم نواز کی نا اہلی بھی معطل ہو گئی ہے۔ جمعرات کے دن جب عدالت عالیہ میں ایون فیلڈ ریفرنس میں احتساب عدالت کی جانب سے سنائی گئی سزائوں کے خلاف بریت کی درخواست کی سماعت پر کارروائی شروع ہوئی تو مریم نواز اور کیپٹن (ر) صفدر اپنے وکیل کے ہمراہ عدالت میں پیش ہوئے جب کہ استغاثہ کے وکیل یعنی نیب کے پراسیکیوٹر عثمان جی راشد اتنی اہم پیشی پر کمرہ عدالت سے غیر حاضر تھے عدالت کے استفسار پر ڈپٹی پراسیکیوٹر جنرل نیب سردار مظفر عباسی نے بتایا کہ وہ "خرابی صحت" کی وجہ سے غیر حاضر ہیں ، اگر عدالت اجازت دے تو میں دلائل دیتا ہوں، جس پر ملزمان کے وکیل امجد پرویز نے ذومعنی انداز میں کہا کہ سردار صاحب! آپ سے اچھے دلائل کوئی اور نہیں دے سکتا چنانچہ سردار مظفر نے دلائل دیے کے بجائے کیس کا ریکارڈ پڑھنا شروع کر دیا جس پر جسٹس عامر فاروق نے ان سے پوچھا کیا سردار صاحب ! آپ یہ سارا پڑھیں گے؟ آپ صرف کیس سے متعلقہ چیزیں پڑھیں۔ 

اس طرح کیس کی کارروائی شروع ہوئی اور اسی طرح آگے بڑھتی چلی گئی، طویل سماعت اور دلائل مکمل ہونے کے بعد عدالت نے فیصلہ محفوظ کر لیا اور کچھ دیر بعد مختصر فیصلہ عدالت عالیہ کی جانب سے سنا دیا گیا اور مختصر تحریری فیصلہ بھی جاری کر دیا گیا۔عدالت تفصیلی فیصلہ کچھہ عرصہ بعد جاری کرے گی جس میں فیصلہ کی وجوہات بھی شامل کی جائیں گی۔احتساب عدالت نے مریم نواز کو مجموعی طور پر آٹھ سال اور ان کے خاوند کیپٹن (ر) صفدر کو ایک سال قید اور نا اہلی کی سزا سنائی تھی جس کے خلاف عدالت عالیہ اسلام آباد نے بریت کی درخواست کی چار سال تک سماعت کی اور آخر اپنا فیصلہ صادر کر دیا۔ سماعت کے آخری روز کی کارروائی کا جائزہ لیا جائے تو واضح ہوتا ہے کہ دوران سماعت نیب کی طرف سے عدم دلچسپی والی کیفیت رہی اور یوں محسوس ہورہا تھا کہ نیب اس کیس میں "نیوٹرل" ہے ۔ نیب کے پراسیکیوٹر عثمان جی راشد ’’ناسازی طبع‘‘ کے باعث عدالت میں پیش ہی نہیں ہوئے جس پر ڈپٹی پراسیکیوٹر جنرل سردار مظفر عباسی نے ملزمان کے وکیل کی خوشنودی سے دلائل پیش کئے اور عدالت عالیہ کو اسی پر اکتفا کرتے ہوئے فیصلہ سنانا پڑا۔ ان دلائل کا معاملہ

"کچھ تو مجبوریاں رہی ہوں گی 

یوں ہی تو کوئی بے وفا نہیں ہوتا" 

سے مختلف نہیں تھا دراصل یہ بات اب مکمل عیاں ہو چکی ہے اور اس میں کوئی شک نہیں رہا کہ ہمارے یہاں قانون موم کی ناک سے زیادہ کوئی حیثیت نہیں رکھتا جسے مختلف حالات اور واقعات میں ضرورت کے مطابق جدھر چاہے موڑا جا سکتا ہے ۔ زیادہ پرانی بات نہیں جب اسی معاملہ کی سماعت کے دوران ملک کی اعلیٰ ترین عدالت عظمیٰ نے ’’شریف خاندان‘‘ کے خلاف فیصلہ سنائے جانے کے وقت اسے ’’سسلین مافیا‘‘ قرار دیا تھا مگر اب وہ بے گناہ ٹھہرے ہیں اور عدالت عالیہ نے میاں نواز شریف کی بیٹی اور داماد کو با عزت بری کر دیا ہے، ظاہر ہے اپنی ہی جماعت سے ہمدردیاں رکھنے والے جس سابق بیورو کریٹ کو وزیر اعظم شہباز شریف نیب کا چیئرمین لگائیں گے اس کی سربراہی میں نیب جیسے ادارے سے کیوں کر یہ توقع کی جا سکتی ہے کہ ’شریف خاندان‘ کی شرافت پر کوئی دھبہ لگانے، انہیں مجرم ثابت کرنے اور سزائیں دلوانے میں کوئی دلچسپی لے گا۔ عدالتوں سے اشتہاری قرار پانے والے محترم جناب اسحاق ڈار صاحب بھی اس سے قبل اپنی مفروری کا حکم عدالت ہی سے معطل کروانے کے بعد پاکستان تشریف لائے اور سینٹ کے رکن اور ملک کے وزیر خزانہ کا حلف اٹھا کر فرائض منصبی بھی سنبھال چکے ہیں دختر نیک اختر اور داماد کی بریت کا فیصلہ عدالت عالیہ اسلام آباد کی جانب سے سنائے جانے کے بعد سابق وزیر اعظم محمد نواز شریف نے بھی پاکستان واپسی کے لیے کمر کس لی ہے ۔ وہ جو شدید بیماری کا ڈرامہ رچا کر اور بڑی مشکلوں اور سفارشوں سے پاکستان سے لندن تشریف لے گئے تھے اب ان کا کہنا ہے کہ ملک سے دور رہ کر ایک ایک دن ان پر بھاری گزر رہا ہے اور وہ علاج کروائے بغیر ہی جلد پاکستان آنا چاہتے ہیں یہ وہ دنیا کے واحد مریض ہونگے جن کا علاج ان عدم موجودگی میں ہورہا ہے۔ چنانچہ انہوں نے اپنے وکلا کو ہدایات جاری کر دی ہیں کہ ان کی وطن واپسی کا راستہ ہموار کرنے کے لیے عدالت سے رجوع کریں۔ انہیں بھی اسی ایون فیلڈ ریفرنس میں قید، نا اہلی اور جرمانہ کی سزائیں سنائی گئی تھیں۔ جس میں ان کی بیٹی مریم نواز اور داماد کیپٹن (ر) صفدر با عزت بری ہو گئے ہیں تاہم نواز شریف کو ہدایت کی گئی تھی کہ پہلے وہ عدالت میں پیش ہوں تب ان کی درخواست پر فیصلہ کیا جائے گا۔ اب امید کی جا رہی ہے کہ جلد ان کی جانب سے راہداری ضمانت کیلئے درخواست دائر کی جائے گی جس کے منظور ہونے کے بعد وہ وطن واپس آ کر جیل میں جانے کے بجائے عدالت کی رسمی کارروائی کا حصہ بنیں گے اور بیٹی اور داماد کی طرح پاکستان کے شفاف نظام انصاف کی کرامات سے نہ صرف با عزت بری ہو جائے گے بلکہ پھر ملکی سیاست میں حصہ لینے کے بھی اہل ہو جائیں گے اور پھر "مقتدر حلقوں" نے یاوری کی تو چوتھی بار ملک کی وزارت عظمیٰ کا منصب بھی ان کا منتظر ہے…!!!

Acquittal of Avonfield Reference Maryam Nawaz and Captain Safdar

Deputy Prosecutor General NAB Sardar Muzaffar Abbasi told the court that he was absent due to "ill health", if the court allows it. No one else can give good arguments than you, so instead of giving arguments, Sardar Muzaffar started reading the record of the case, on which Justice Amir Farooq asked him, Sardar Sahib! Thus the proceedings of the case began and proceeded in the same manner, after the completion of lengthy hearings and arguments, the court reserved its judgment and after some time the summary judgment was pronounced by the High Court and a summary written judgment was also issued. The court will issue a detailed decision after some time, in which the reasons for the decision will also be included. was sentenced, against which the Islamabad High Court heard the plea of ​​acquittal for four years and finally issued its decision. If we review the proceedings of the last day of the hearing, it is clear that during the hearing NAB was disinterested and it was felt that NAB is "neutral" in this case. NAB Prosecutor Usman G. Rashid did not appear in the court due to his "unsatisfied nature", on which the Deputy Prosecutor General Sardar Muzaffar Abbasi presented the arguments to the satisfaction of the accused's lawyer and the High Court had to give a verdict based on this. . After the acquittal of Akhtar and his son-in-law by the Islamabad High Court, former Prime Minister Muhammad Nawaz Sharif has also tightened his belt to return to Pakistan. He who came to London from Pakistan after pretending to be seriously ill and with great difficulties and recommendations, now he says that each day being away from the country is taking a toll on him and he has to come to Pakistan soon without getting treatment. They want to be the only patients in the world who are being treated in their absence. Therefore, they have issued instructions to their lawyers to approach the court to pave the way for their return home. He was also sentenced to imprisonment, disqualification and fine in the same Avonfield reference. In which his daughter Maryam Nawaz and son-in-law Captain (retd) Safdar have been acquitted with honour, however, Nawaz Sharif was instructed to appear in court first and then a decision will be taken on their request. Now it is hoped that an application for transitory bail will be filed soon on his behalf, after which he will return to his homeland and instead of going to jail, he will be a part of the formal proceedings of the court and like his daughter and son-in-law. Thanks to the virtues of Pakistan's transparent justice system, they will not only be acquitted with dignity, but they will also be able to participate in the country's politics, and if the "powerful circles" help them, they will also be the prime minister of the country for the fourth time.
